In these Terms and Conditions "we" and "us" mean Mooloolaba Music Pty Ltd of Shop 2 Minyama Place,  Corner Nicklin Way & Kensington Drive Minyama QLD 4575 AUSTRALIA and "you" and "your" means you the customer.

These Terms and Conditions together with your order constitute the entire Contract between us and you for the supply of Products. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email prior to the event.

Legal Capacity to Transact

If you are under the age eighteen (18) years you can not place orders with Mooloolaba Music Centre.

By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. Any orders placed and accepted by us will be deemed to be by persons over the age of eighteen (18) years.

Should Mooloolaba Music Centre suffer any damage or other losses as a result of a transaction entered into by a minor, Mooloolaba Music Centre reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Mooloolaba Music Centre.

Placing Your Order

You may place your order by filling in the order form on this website.

When you place your order, we will issue you with an order number. We will do this by email.

By placing an order, you make an offer to us to purchase the products you have selected based on these Terms and Conditions.

We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered.

If we cannot process or accept your order after payment is received we will contact you by email or telephone.

Mooloolaba Music Centre reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.

Payment Methods and Processing


The payment method options will be available within the Checkout page, pending the total invoice amount.
Mooloolaba Music Centre accepts Visa, MasterCard or PayPal. (There are max limits in place for Credit Cards)

BPAY & Bank Transfer (direct deposit to our bank account) is also available. Orders paid from these methods will not be processed until payment has been received. ( No max limits apply for Bank Transfer payments)

Please ensure that you include the order/ invoice number in the transaction description.

Payment processing will not begin until we receive all the information we need.

Orders placed on a weekend or a public holiday will not begin payment processing until the next business day.

Business days are Monday through Friday, excluding Queensland public holidays.

We process credit card payments after you click the "Submit My Order" button.

For credit card payments we will email a tax invoice to you with your order confirmation. Your tax invoice is your proof of purchase.

Please Note:

  • We will not accept credit cards issued by banks outside of Australia.
  • Debit cards and cheque cards have daily spending limits that may substantially delay the processing of your order.
  • You may be required to provide further identification for additional security reference checks.

Layby Terms and Conditions -

Mooloolaba Music offers Layby to Customers

  • Minimum Value - Lay-by is available on purchases of $100 or more

  • Deposit - A 20% deposit is required for each new lay-by

  • Term – Lay-by is available on a 8 week term and must be paid in full and collected by the finalisation date.

  • Payments – Payments may be made online with either Direct Deposit with a Layby Ref # or over the counter in the store.

  • Termination & Fees – Failure to finalise the payment in full by due date will automatically cause termination of layby & incurr non refundable restocking fee of 20% of all monies paid

Specials And On Sale Products

Both New and Demo stock can be listed as ON SALE. Some products may be shop soiled as a result of being on display in Store. In some cases the original packaging will not be available to ship to you.

The price and availability of each ON SALE product can change without notice.

Usually ON SALE Stock is limited to One Only In-Store!

GST

All prices quoted on this website are inclusive of GST except for items that are exempt from GST. Items that include GST, and the total GST paid will be clearly marked on the invoice.

Prices

All prices are stated in AUD, Australian Dollars. Mooloolaba Music Centre always seeks to list Products with competitive prices. Mooloolaba Music Centre reserves the right to change prices for Products displayed at the Mooloolaba Music Centre website at any time.

Supply of Products

Subject to these Terms and Conditions, we will supply to you the Products indicated on your order confirmation.

Delivery Charges

Mooloolaba Music Centre reserves the right to change prices for delivery at any time.

If you choose to pickup the goods ordered/purchased on-line from our Store at Minyama QLD, then no delivery charges will apply.

Delivery charges apply to goods that are sent to your nominated address or shipped outside our Store at Minyama QLD, and are subject to confirmation at the time the order is placed.

Delivery Times

All orders on this website are processed ASAP during business hours Monday-Friday. If there are any unforeseeable delays, you will be contacted by our customer service team.

Please allow 3-14 working days for delivery.

Where the product is not available ex store stock we will source from our supplier. In some situations our supplier may be out of stock and in this case we will email you immediately and advise a likely waiting time. If the waiting time is not acceptable to you, your payment will be fully refunded immediately and the order cancelled.
 
With our nominated Courier Service we recommend that your nominated delivery address is one where someone is present to accept your delivery during Business hours of 9-5 Monday-Friday. Our courier cannot guarantee a specific delivery date or time. If no one is present to accept the delivery a slip will be left so that you can negotiate a suitable arrangement for final delivery or collection.
Although every effort is made to ship your order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your Product has not arrived after the estimated delivery time, please contact us here.

Please note:

  • It is the responsibilty of the Customer upon delivery of the goods, by the nominated Courier to ensure the packaging or goods have not been damaged during shipping.
  • Title and risk of loss to all products will pass to you upon delivery.
  • If the Customer request goods to be left without providing a signature upon delivery, then the Customer will be accepting full liability.

Refund Policy

You are entitled to a refund or repair or exchange or credit if the products you have bought are:
• faulty;
• significantly different to those shown or described to you; or
• not doing what they are supposed to do.

When you buy, you should choose carefully. You don't automatically get a refund for simply changing your mind, unless this was a condition of the sale or part of our advertised policy.

Please keep your receipt as proof of purchase.

If you find that the goods were damaged in transit or were faulty in some manner, please contact us within 24 hours of receiving the goods. We will organise for the return of the goods and arrange a credit towards your next purchase or send a replacement product. The Customer will incur the cost of return postage and be credited the purchase price only.

Products Damaged in Transit

Our courier will endeavour to supply you with the product you have ordered from us in the condition that the goods were dispatched. However on occasion goods may be damaged in transit to you. If this occurs, please either email us at or call the courier's customer service team.

Authority To Leave - Shipping Instructions

If you would prefer for the delivery person to leave the parcel for you in your absence, please just put an
(ATL), Authority To Leave note (and your preferred location for the goods to be left) in the
"Delivery Instructions'' box located in the checkout.

It is important to consider that if you give us (ATL), Authority To Leave the consignment in your absence, then we can no longer guarantee that you will receive your goods, nor the other factors that can effect your parcel whilst it is sitting unattended - like theft, rain, heat, dirt, damage, etc. In this situation, we can only guarantee delivery and quality up to the point that the track and trace tells us the goods were left for you.

Faulty Products

Mooloolaba Music Centre is proud to offer our customers quality products. We will endeavor to supply you with product you have ordered in good condition. However, on occasion goods that are sealed within cartons may be faulty as a result of a manufacturing defect from our suppliers. If this occurs please We will rectify the situation at our discretion.

Returns

In the event of an item that has to be returned please email us with your name, invoice number, product name, reason for return and request for replacement, exchange or refund for store credit.

You will be issued with a Return Authorisation Number which is to be written on the outside of the returned package. At the same time you will be given the address to return the package to. It may be us, the distributor of the product, or the authorised repairer. In the event an item has to be returned to us all freight costs are to be borne by the purchaser.

Cancellations

In the event an order cancellation is approved by Mooloolaba Music management, you will be charged a $30 admin fee and 20% restocking fee if we have placed the order with a supplier. These charges are to offset time lost in labour and any unintended acquisition of stock on the part of Mooloolaba Music. 

Free Shipping


If the product you are purchasing indicates Free Shipping, then we will deliver to you with no shipping fee, this applies to most Australian addresses, but excludes remote Australian locations.  If your delivery address is a remote location or one that our nominated Carrier does not deliver to, then we will inform you & work out a alternative shipping address or refund to you to reverse the sale.

Information on this website is provided 'as is' and we disclaim all representations, warranties and conditions, express or implied of any kind, including to the extent permitted by law, as to satisfactory quality or fitness for purpose.

Under the Trade Practices Act 1974 ("Act"), where implied conditions and warranties cannot be excluded, any liability in Mooloolaba Music Centre for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option Mooloolaba Music Centre, to the replacement of the Product(s) or the re-supply of the same Product(s); the payment of the cost of replacing the Product(s) or of acquiring equivalent Product(s).

Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.

Mooloolaba Music Centre reserves the right to change the Terms and Conditions of sale at any time.

No Mooloolaba Music Centre employee or agent has the authority to vary any of the Terms and Conditions governing any sale.

Force Majeure

Mooloolaba Music Centre shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Mooloolaba Music Centre, and Mooloolaba Music Centre shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland and shall be subject to the non-exclusive jurisdiction of the courts of Queensland.
